National Archives to review all Kavanaugh records by October, potentially delaying confirmation

A delay in the confirmation process would give Democrats more time to hammer Kavanaugh, a conservative jurist they fear could swing the high court to the right for decades and imperil landmark cases like Roe v. Wade.

Democrats wrote to the National Archives requesting a broad set of the documents, using a letter with almost the same language that was sent by both parties in 2010 seeking documentation about Obama's nominee Elena Kagan.

According to the National Archives, there are roughly 560,000 pages of paper records related to Kavanaugh's time as staff secretary and another 475,000 emails either sent or received where Kavanaugh was copied. "In the end, the committee will have reviewed significantly more records than ever before for a Supreme Court nominee", Foy said.

The fight over documents has become the biggest issue in the battle over Judge Kavanaugh, with Democrats insistent that Republicans are trying to whitewash his record by not requesting the files from his time as staff secretary to Mr.

Grassley said he would prefer a Kavanaugh confirmation hearing in early September, since it could take the committee two weeks to vote on the nomination because of committee rules. "The Bush Library will produce to us over 125,000 pages today", said the aide.

Grassley had requested the documents to begin rolling production by August 1, to be completed by August 15. They say senators don't need to review an additional 1 million papers on Bush-era policies like the interrogation of terror suspects beyond those already being compiled.

National Archives General Counsel Gary Stern pointed out that this request far exceeded past document requests for other Supreme Court Justice candidates.


The GOP statement said the committee was counting on receiving documents "in an even more rapid fashion" from the archives of the George W. Bush Presidential Library.

And even if one is concerned about this possibility, one solution would be to have the Archives folks review any documents the Bush team says should be withheld.

Senate Republicans said Thursday by the time they vote on Judge Brett Kavanaugh's nomination to the Supreme Court, they will have gotten more documents from his past than for the previous five nominees combined.

But Republicans have requested only a portion of the records, leading Senate Minority Leader Chuck Schumer to accuse Republicans of having "cast aside Democratic wishes for openness and transparency". The signing statement suggested that Bush could circumvent the law.

"If we can get this all done by October 1 when the Supreme Court starts its new fall session it would be ideal, but I think we can get it done soon after that, if we don't get it done by October 1", Grassley said.

The term Bork - recognized in the Oxford American Dictionary since 2002 - refers to what Hatch called the "unprecedented campaign of character assassination" waged against Judge Robert Bork during his 1987 Supreme Court confirmation hearing.
