The JUUL vape pen is an e-cigarette that comes with a vaporizer and pre-filled containers of nicotine liquid. Yesterday the Food and Drug Administration, responding to anecdotal reports of students who juul during school, announced that it is investigating whether the company is marketing its products to minors.

The FDA's action came in response to last week's letter from 11 U.S. Senators, including Democrat Dick Durbin of IL, calling on the FDA to ban candy and fruit flavorings in e-cigarettes and cigars.

FDA commissioner Scott Gottlieb, a physician and FDA veteran who served on President Donald Trump's transition team, has been feeling heat about the issue recently.

"At the same time, we are committed to deterring young people, as well as adults who do not now smoke, from using our products".

"As part of the FDA's responsibility to protect kids and significantly reduce tobacco-related disease and death, these are the first steps in a new effort aimed at stopping youth use of e-cigarettes", the FDA said in a statement. The FDA made a decision a year ago to delay its regulation of e-cigarette products and flavorings from 2018-2022.

In a statement provided to Side Effects Public Media, a spokesperson for JUUL Labs said the company "agrees with the FDA that illegal sales of our product to minors are unacceptable". "Juul flavors include "Creme Brulee" and 'Fruit Medley, ' which critics have said make it more attractive to minors", write Saabira Chaudhuri and Anne Marie Chaker for the Wall Street Journal. "The Campaign for Tobacco-Free Kids, Truth Initiative, American Academy of Pediatrics, American Cancer Society Cancer Action Network, American Heart Association and American Lung Association sent a letter to Gottlieb warning that progress against smoking is "at serious risk of being reversed" because of the agency's failure to take action against products that appeal to youth", reports Laurie McGinley for the Washington Post.

"We're also taking additional steps to contact the manufacturers directly, and hold them accountable". "We need to examine all the available information to understand why kids are finding these products so appealing- and address it".

It also contacted JUUL Labs directly requesting documentation related to marketing, research on the products' effects on health, toxicology, behavior and physiology, including youth initiation and use, whether certain design features, ingredients or specifications appeal to different age groups and youth-related adverse events and consumer complaints. If these manufacturers, including JUUL, do not comply with the organization's requests, law enforcement measures may be taken.

"Let me be clear to retailers".

Juul sales have exploded over the past two years and the brand now accounts for 55 percent of the U.S. market for e-cigarettes, according to industry figures.

Cleveland19 reached out to Juul Labs.

"We are working with the FDA, lawmakers, parents and community leaders to combat underage use, and we will continue working with all interested parties to keep our product away from youth".

"So they can use it when the teacher has got their back to the class", Sexton said.

The FDA said that such products are also more hard for parents and teachers to recognize or detect, potentially adding to its appeal for the youth.

He said that while fewer teens are getting hooked on tobacco products, they are increasingly turning to vaping and e-cigarette companies know this. The senators urged FDA to end the delay and begin regulation and review of e-cigarette products now. The agency also is responsible for the safety and security of our nation's food supply, cosmetics, dietary supplements, products that give off electronic radiation, and for regulating tobacco products.
