Federal Bureau of Investigation agents searched Cohen's home, hotel room, office, a safety deposit box and seized two cellphones in a raid on Monday that drew a furious reaction from Trump.
Cohen did not immediately respond to a request for comment.
Court filings Friday provided insight into the government's own skepticism over Cohen's claims about the material seized earlier this week.
President Donald Trump's personal attorney, Michael Cohen, has been under criminal investigation for months by federal prosecutors who empaneled a grand jury to probe his business dealings beyond his law practice, according to a new court filing.
Cohen's attorney said this week that the NY investigators and attorneys who have been working on the case were referred by Justice Department special counsel Robert Mueller, who is based in Washington, D.C. Cohen told ABC News the operation was "respectful" and "courteous", but the agents carted away documents and Cohen's electronic devices. Daniels' lawyer, Michael Avenatti, argues that the court must first decide if there even is an agreement and has asked for limited discovery, including depositions of Trump and Cohen and production of certain documents, in order to prove there is not. The hearing was set for Monday afternoon.
At the outset, Harrison brought up his concerns about how the government meant to proceed with the material the government seized during the raids.
Of Trump, McKay said: "His attorney-client privilege is no greater than any other person who seeks legal advice".
Hendon contended that she had only been retained on Wednesday, two days after the raids. He did not disclose the reason for the court proceeding.
She also stated that the government's actions raised unspecified "fairness issues" toward its investigation.
Wood said the intervention of a court or special master in the process was not unprecedented, citing the prosecution of Lynne Stewart, a radical Manhattan lawyer who was charged with smuggling communications out of prison for one of her clients.
"He is the president of the United States", she said. She also raised concerns about "innocent parties" having their privacy violated based on material being discussed.
Avenatti said he believes some of the seized documents relate to Clifford, who performs under the name Stormy Daniels.
Another lawyer also sought to make his case: Clifford's attorney Michael Avenatti.
Cohen joined the Trump Organization as general counsel in 2006.
Under US law, communications between attorneys and their clients are privileged and must remain confidential, but judges can grant exceptions in cases involving criminal wrongdoing. In them, they found that Cohen had done "little to no legal work, and that zero emails were exchanged with President Trump".
Cohen is asking for the right to review the documents before investigators do, so he can determine if any information was covered by attorney-client privilege. Or, they said, the court could appoint a special master for that goal.
The court is scheduled to take the issue back up at 2 p.m. Monday.
