The court in Schleswig-Holstein in the north of the country ruled that the man wanted by Madrid for his role in last year's declaration of independence can be freed on bail of €75,000.

Spain's Supreme Court reactivated global arrest warrants last month for Puigdemont and four other Catalan politicians who went into self-imposed exile past year.

The former Catalan separatist leader was detained in Germany last month on an worldwide arrest warrant issued by Spain when he was driving back from Finland through Denmark on his way to Belgium.

Puigdemont's German lawyer said the separatist politician was arranging the transfer of the bail money to Germany.

The court has been considering what to do about a Spanish extradition request for Mr Puigdemont for more than a week.


The German judges will consider Puigdemont's extradition on the less serious charge of misusing public funds.

Spain has accused the former Catalan president of rebellion, but the court concluded that the closest equivalent to this in German law was high treason.

The former Catalan leader's German defense team welcomed the court's decision to dismiss the Spanish government's "outrageous" rebellion charge, adding that the case had a "trend-setting significance for the European understanding of democracy".

"The actions for which the subject is being prosecuted would not be criminal under German law", the court spokeswoman said.

Puigdemont has written an open letter from prison, urging Catalonia's parliament to make another attempt to elect jailed separatist activist Jordi Sànchez as the region's president. Two other members of the regional police and an official with the regional interior department were also indicted Thursday.
