Catalan parliament defies Spain again with vote on leader

A rift between the Scottish and United Kingdom governments has opened up over the fate of a political fugitive from Catalonia who is facing extradition to Spain.

The academic is due at an initial extradition hearing at Edinburgh Sheriff Court Wednesday.

"She can not believe that she is being held responsible for the violence that took place on the day of the referendum", Anwar said outside court.

Professor Ponsatí, 61, has said that she will hand herself over to the authorities in Scotland this week after the Spanish courts issued a European arrest warrant for her and other exiled Catalan leaders.

Clara Ponsatí, now head of the school of economics and finance at the University of St Andrews, has been charged with rebellion and misuse of public funds in her home country.

Ponsati's lawyer Aamer Anwar said she would contest the charges, which amounted to political persecution. In March, Ponsati moved back to Scotland and her position as a professor at St. Andrews University.

Catalonia's parliament has passed a symbolic motion affirming the right of the Spanish region's former separatist leader Carles Puigdemont to be re-elected to his old job, even though he is in jail and facing a possible trial.

A crowd-funding appeal set up on Wednesday to pay for her legal costs had raised more than £158,000 by mid-afternoon.


In a statement issued this morning, her solicitor Aamer Anwar said: "After we enter the police office my client will be formally placed under arrest".

"She faces charges of rebellion with violence against the unity of the Spanish nation, but along with other politicians she promoted a peaceful referendum to express a democratic desire for independence from Spain".

Ponsati was a minister in the Catalan government when it declared independence from the rest of Spain following a referendum in October.

Former Catalan leader Carles Puigdemont is in custody in Germany after being arrested under an worldwide warrant.

Anwar thanked the "many hundreds of thousands of ordinary people" who had backed Ponsati, including Scottish First Minister Nicola Sturgeon.

Despite sympathy for Catalonia among Scotland's independence movement and the SNP membership, the Scottish government won't do anything concrete to defend Catalan democracy.

Their supporters argue that the ex-ministers should not be extradited because they will not receive a fair trial in Spain, hoping for a repeat of a recent Irish court ruling in which a man's extradition to Poland was referred to the European Union courts over concerns about the rule of law in Poland.

Ms Ponsati's lawyer told the BBC yesterday that they would be challenging the rebellion charge, insisting that there was no similar crime in Scotland and that "the only people responsible for violence on [referendum] day were the Spanish police".
