Federal Bureau of Investigation agent shoots bound kidnapping victim dead in botched raid

Cunningham told investigators that Valladares was being held at Heath's home in northeast Houston, according to court documents.

Victim Ulises Villadares was shot to death and later pronounced dead at a nearby hospital.

Meanwhile, Conroe police contacted the FBI, and agents using a federal warrant traced the caller's phone to the area of a Best Western hotel about an hour away.

Cunningham and Sanchez burst into the man's Conroe home on Wednesday morning, demanded money, tied up the man and his 12-year-old son and then ransacked their home, according to detectives.

According to a criminal complaint obtained by KTRK, the men told the victim that his brother owed them $8,000 and demanded $20,000 in ransom. Eventually, the two assailants took Villadares out of the house, leaving his son behind but not before telling the child not to call police or else they'd kill his father.

After, a neighbor called the boy's uncle at work, he came home to speak with police. At some point in the raid, one of the agents fatally shot Valladares. Neighbors say they woke up to the sound of gunshots around on Thursday. Earlier that day, two men with guns forced their way into Villadares' home. Both have been charged with aggravated kidnapping and aggravated robbery and it is unclear if either has lawyers who can speak on their behalf at this time.

Authorities arrested Nicholas Chase Cunningham, 42; Jimmy Tony Sanchez, 38; and Sophia Perez Heath, 35, for their involvement in the kidnapping. Agents also located the cellphone used to call the brother, according the court documents. Garza said the agent who fired the fatal shot is on administrative leave pending an investigation. "Whether it was accidental or not, the man's not going home to his family". The FBI says two children were inside the home when the man was killed. "The female has been charged with aggravated kidnapping". "We do this job to help people and it doesn't always go our way", Conroe Police Chief Philip Dupuis said Thursday, per the Houston Chronicle. As with any agent-involved shooting, the Shooting Incident Review Team will investigate the matter.

"Even though it appears one possibility is friendly fire, the kidnappers put this into play, so they're ultimately responsible for the outcome", explains Montgomery County District Attorney Brett Ligon.
