The legislation was brought to parliament through the upper house, following a non-compulsory, non-binding postal survey in which 61.6 per cent of people voted Yes.

Thursday was set to be a historic day for gay marriage advocates in Australia, with same-sex marriage expected to pass in the late afternoon.

In moving scenes, the entire parliament burst into song after the bill passed, belting out the lyrics to the "I Am Australian" song: "We are one, but we are many; And from all the lands on earth we come; We'll share a dream and sing with one voice; "I am, you are, we are Australian".

A review into religious freedom will report in March, which could lead to further law changes.

The law is likely to take effect in around a month, after royal assent and other formalities are completed, according to The Washington Times.

"What a day, what a day for love, for equality, for respect", he said.

"This is Australia - fair, diverse and filled with respect".

"Equality isn't in our legal birthright of every Australian and this equality is long overdue", added Mr Shorten.

"The last thing we should want to do is to subject Australians to new forms of discrimination in place of old ones that are rightly gone", he said.

"We are simply Australians one and all".

"I think we got to marriage equality in spite of Malcolm Turnbull, not because of him", he told reporters in Sydney.

Gay couples who tied the knot overseas will now have their unions officially recognised.

The result is a political win for Turnbull, who became prime minister after deposing Abbott in 2015 in an internal government leadership ballot.

Supporters of the legislation defeated attempts to attach amendments to the bill aimed at undermining the rights of married gay couples.

The new laws cleared parliament unchanged on Thursday evening after a marathon debate lasting 56 hours and despite a push from conservative MPs for additional religious protections.
