Henderson said the two fidget spinners referred to in the lab tests contained clear marking on their packaging saying they were appropriate for customers over the age of 14. Additionally, online the "Fidget Wild Spinner Premium Brass" is labeled for ages "six and up". Also, just common sense, we know that kids play with fidget spinners all the time!
A consumer advocacy group announced a fidget spinner sold at Target stores tested positive for high levels of lead. "They are not defined by the CPSC as toys".
In the meantime, U.S. PIRG still recommends for adults and children to stop using the fidget spinners.
The CDC says there is no such thing as a safe level of lead in the bloodstream, and that lead poisoning in children can cause damage to the brain and nervous system, slowed growth and development, learning and behavior problems such as ADHD and criminal behavior, and hearing and speech problems. Said a spokesperson for Target: "The Consumer Product Safety Commission (CPSC) has reviewed and explicitly defined fidget spinners as 'general use products.' They are not defined by the CPSC as toys". But Target doesn't appear to be backing down, not even to claims that they should move the fidget spinners to another section of the store.
The study was conducted on the Fidget Wild Premium Spinner Brass and Fidget Wild Premium Spinner Metal.
According to the Centers of Disease Control and Prevention, lead's toxicity resulted in its ban in household paints and products marketed to children in 1978.
"Safety is one of our top priorities", Howard Chizick, a spokesman for Bulls-I-Toys, said in an email.
PIRG Education Fund is calling for the toys to be pulled from shelves and wants a recall issued. A spokeswoman for the CPSC said she could not comment specifically on the products being sold by Target.
"If a fidget spinner is marketed and is primarily intended for children 12 years of age and younger, companies must certify that their product meets toy safety and other standards, including limits for phthalates, lead content, and lead in paint, if applicable, and the U.S Toy Standard, ASTM F963-16", CPSC acting Chairman Ann Marie Buerkle said in an August 10, 2017 statement on fidget spinners.
U.S. PIRG publishes an annual report on toy safety, which has led to more than 150 product recalls and regulatory actions over the past 30 years.
